These Terms of Service ("Terms") govern your use of the Fireteam platform operated by Hekla Ventures LLC ("Fireteam," "we," "us," "our"). By subscribing to or using Fireteam, you ("you," "your," the "Business" or "Subscriber") agree to these Terms.
1. Overview of Service
Fireteam is an AI-powered back-office platform for trades companies. Our services include:
- AI Receptionist — An AI-powered voice assistant that answers inbound calls, classifies caller intent, and routes calls appropriately.
- Missed-Call Text-Back (MCTB) — Automated SMS sent to callers whose calls go unanswered.
- SMS Conversations — AI-powered text message exchanges with callers for scheduling, quote requests, and general inquiries.
- Review Automation — Post-job review request SMS and AI-drafted Google review replies.
- Owner Dashboard — A web interface for monitoring calls, messages, and business performance.
2. Account Registration and Eligibility
To use Fireteam, you must be at least 18 years old, be authorized to act on behalf of the business you are registering, provide accurate and complete registration information, and maintain the security of your account credentials.
You are responsible for all activity under your account. Notify us immediately at support@fireteams.co if you believe your account has been compromised.
3. Acceptable Use
You agree to use Fireteam only for lawful business purposes. You will not:
- Use the platform to send unsolicited marketing messages without proper consent.
- Use the AI receptionist to misrepresent that callers are speaking with a human when they ask directly.
- Provide false business information during registration.
- Use the platform to harass, threaten, or defraud any person.
- Attempt to reverse-engineer, decompile, or extract source code from the platform.
- Resell or sublicense access to Fireteam without our written permission.
- Use the platform in violation of the Telephone Consumer Protection Act (TCPA), state telemarketing laws, or carrier regulations.
4. Telephony and SMS Compliance
Your Obligations
As the business using Fireteam to communicate with your customers, you are responsible for:
- Consent: Obtaining and maintaining appropriate consent before Fireteam sends messages to your customers. Fireteam provides tools to track consent, but the legal obligation to obtain consent is yours.
- 10DLC Registration: Fireteam registers its brand and messaging campaigns with The Campaign Registry (TCR) through our telephony provider. You must provide accurate business information for this registration.
- Opt-Out Compliance: Fireteam automatically processes STOP requests. You must not contact individuals who have opted out through any channel.
- Truthful Business Information: The information presented by the AI receptionist must be accurate. You are responsible for keeping this information up to date.
Fireteam's Obligations
We will process opt-out requests (STOP) immediately and automatically, observe quiet hours (no automated messages before 8 AM or after 9 PM in the recipient's local time), maintain consent records for a minimum of 5 years, provide an audit trail for all automated messages sent on your behalf, and register and maintain 10DLC campaigns with carriers.
Shared Responsibility
SMS and voice compliance is a shared responsibility. Fireteam provides the infrastructure and guardrails; you provide the business context and customer relationships. If a compliance issue arises, we will work together to resolve it. However, if you knowingly direct Fireteam to send messages in violation of applicable law, you bear sole responsibility.
5. AI Disclosure and Limitations
Fireteam's AI receptionist is designed to handle common inbound call scenarios for trades companies. You acknowledge that:
- AI is not perfect. The AI may occasionally misclassify a caller's intent, provide an incorrect response, or fail to understand an unusual request. You should review AI-handled interactions regularly using the dashboard.
- AI is not a substitute for human judgment in emergencies, legal matters, billing disputes, or sensitive customer complaints. The AI is designed to escalate these situations to a human.
- Call recordings and transcripts are generated automatically. You are responsible for compliance with call recording laws in the states where you operate.
- AI-drafted review replies are suggestions only. You must review and approve each reply before it is posted publicly.
6. Data and Privacy
Your use of Fireteam is subject to our Privacy Policy.
Your Data
You retain ownership of your business data, customer data, call recordings, and message content. You grant Fireteam a license to store, process, and transmit this data solely to provide the service.
Customer Data
You are responsible for your customers' data privacy. You represent that you have the legal basis to share customer contact information with Fireteam for the purpose of providing communication services.
Data Portability
You may export your data (call logs, message history, customer records) at any time via the dashboard or by request to support@fireteams.co.
Data Deletion
Upon account termination, we will retain your data for 90 days (in case of reactivation), then delete it. Consent records and audit logs are retained for 5 years per legal requirements.
7. Pricing and Payment
- Fireteam is a subscription service. Current pricing is available at fireteams.co/pricing or as quoted in your service agreement.
- Payments are processed monthly via Stripe.
- Usage-based charges (per-minute voice, per-message SMS) are billed at the end of each billing cycle.
- Prices may change with 30 days' written notice.
- Accounts with unpaid balances for more than 30 days may be suspended.
8. Service Level
- We aim for 99.9% uptime for the dashboard and API.
- Voice and SMS services depend on third-party providers (Twilio, Vapi, ElevenLabs) and are subject to their availability.
- We will notify you of planned maintenance at least 24 hours in advance when possible.
- Emergency escalation (call transfer to your phone) depends on your phone being on and reachable. Fireteam is not responsible for missed emergency escalations due to your phone being off, in airplane mode, or out of service.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Fireteam's total liability to you for any claims arising from or related to these Terms or the service shall not exceed the fees you paid to Fireteam in the 12 months preceding the claim.
- Fireteam shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, lost profits, or loss of business opportunity, even if we have been advised of the possibility of such damages.
- Fireteam is not liable for the actions of the AI receptionist that result from inaccurate business information you provided.
- Fireteam is not liable for TCPA violations resulting from your failure to obtain proper consent.
10. Indemnification
You agree to indemnify and hold harmless Fireteam, Hekla Ventures LLC, and our officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the platform in violation of these Terms, your violation of applicable law, your failure to obtain or maintain proper consent, and any claim by a third party related to content you provided to the platform.
11. Termination
- You may cancel your subscription at any time. Service continues through the end of the current billing period.
- We may suspend or terminate your account if you violate these Terms, fail to pay fees, or use the platform in a way that creates legal risk for Fireteam or other users.
- Upon termination, your data is retained for 90 days, then deleted (except consent records and audit logs).
12. Intellectual Property
- Fireteam and its associated technology, branding, and documentation are the property of Hekla Ventures LLC.
- You retain ownership of your business name, logo, and customer data.
- The AI receptionist persona ("Maggie") and its voice, scripts, and behavioral patterns are the intellectual property of Fireteam. You may not replicate, clone, or redistribute the AI persona outside the platform.
13. Dispute Resolution
- These Terms are governed by the laws of the State of Maine, without regard to conflict-of-law principles.
- Any dispute arising from these Terms shall first be subject to good-faith negotiation for 30 days.
- If negotiation fails, disputes shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, conducted in Portland, Maine.
- Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction.
14. Modifications
We may modify these Terms with 30 days' written notice (email to your registered address). Continued use of the platform after the effective date of modifications constitutes acceptance.
15. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy and any service agreement, constitute the entire agreement between you and Fireteam.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- No Waiver: Failure to enforce a provision does not waive our right to enforce it later.
- Assignment: You may not assign your account or these Terms without our consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.
